Can I find a job in the United States without a Green Card?
-
Yes, you can—provided you hold an H1B work visa (or another type of U.S. work visa) or an EAD card.
After all, not possessing a Green Card does not preclude you from working legally; holding an H1B work visa, another type of employment-based visa, or an EAD (Employment Authorization Document) allows you to remain in the United States and work.
Let’s start with the most common type: the H1B work visa. The H1B is a temporary work visa issued to individuals intending to work in the United States for a limited period. The initial validity period for an H1B holder is three years, and it can be extended once, up to a maximum of six years. If, during this period, the employer is sponsoring the employee for a Green Card, the visa may be extended indefinitely—typically in one-year increments—until the Green Card is obtained. However, whether applying for an H1B or any other U.S. work visa, the process invariably begins with the employer filing a petition on your behalf with U.S. Citizenship and Immigration Services (USCIS). Once that petition is approved, you must then take the approval notice and other required documents to a U.S. consulate in China to apply for the actual visa stamp.
Therefore, the most critical requirements for obtaining a work visa are as follows:
1. Secure a job in the United States and possess an employment contract; and 2. Obtain visa sponsorship from a U.S. company.
Furthermore, listed below are the various U.S. work visa classifications, each tailored to different employment scenarios:
H-1B Visa:
This is the most common visa for skilled professionals, applicable to foreign workers possessing specialized qualifications in specific professional fields; it typically requires the support and sponsorship of a U.S. employer.
H-2B Visa:
Applicable to temporary non-agricultural workers, such as seasonal workers, workers in the entertainment industry, etc.
H-2A Visa:
Applicable to short-term agricultural workers.
L-1 Visa:
Applicable to employees of multinational corporations who are being transferred internally, including managers, executives, and specialized staff.
O-1 Visa:
Applicable to foreign nationals with extraordinary abilities—such as Nobel Prize laureates, internationally renowned artists, athletes, etc.
J-1 Visa:
Applicable to exchange visitors, encompassing categories such as academics, professionals, researchers, and others.
F-1 Visa:
Although primarily a student visa, it allows students to apply for work authorization (such as CPT or OPT) during their studies to gain practical work experience.
Another scenario involves the EAD (Employment Authorization Document):
An EAD is a document issued to individuals authorized to work in the United States based on their specific immigration status or circumstances. It permits the holder to engage in employment within the U.S. without requiring specific employer sponsorship. Obtaining an EAD typically involves filing Form I-765, and—depending on the individual's specific situation—an application fee may be required.
EADs are particularly important for individuals holding non-immigrant statuses that do not automatically confer work authorization—such as certain F-1 or M-1 students. The validity period of an EAD is typically limited and is aligned with the duration of the applicant's specific status or circumstances. EAD holders must apply for a renewal prior to the document's expiration to avoid any interruption in their work authorization.
However, a key distinction between a U.S. Green Card and other U.S. work visas or EADs lies in the duration of residency and employment flexibility. A Green Card grants long-term residency rights, allows the holder to pursue any desired line of work—with the freedom to change jobs at any time—and, after five years of residency, enables them to apply for U.S. citizenship. In contrast, holders of other work visas are generally restricted to working for the specific employer that sponsored their visa; if they wish to change jobs, they must first verify whether the prospective new employer is willing to sponsor a new visa application—a process that is considerably less convenient compared to holding a Green Card.
A work permit is not necessarily the same thing as a Green Card. Even if there are issues with your immigration status in the U.S., you may still be eligible to apply for a work permit (EAD) and file taxes normally. Once you possess a work permit, companies can legally hire you.
Another avenue is the work visa system, which also provides legal status. These range from high-tier options like the L-1 visa to mid-tier options like the H-1B, and lower-tier categories such as the EB-3 (EW-3).
If you have traveled to the U.S. on a tourist visa and currently lack formal immigration status, I am confident that you can still find work—specifically as a nanny or cleaner—in cities like Los Angeles or New York, earning an hourly wage of $15 to $25. It typically takes just a few months to successfully obtain a work permit.
However, when it comes to job hunting in general, I don't necessarily think Los Angeles or New York are the easiest places to find employment; the competition is intense due to the high volume of undocumented immigrants. You might want to consider looking into other locations, such as Houston or Chicago.
For physically demanding jobs, earning around $5,000 a month is not difficult to achieve. Administrative or clerical positions, on the other hand, typically pay around $3,000. For skilled blue-collar trades—those requiring technical expertise—earnings can exceed $8,000. Furthermore, there are training schools available (including those offering instruction in Chinese) to help you prepare for licensing exams to become an electrician or plumber.
